INFORMATION TEXT ON THE PROCESSING OF PERSONAL DATA
Personal Data Protection Law No. 6698 came into force after being published in the Official Gazette No. 29677 dated 07.04.2016. The Law which was prepared by taking into account international documents, comparative law practices, and the needs of our country, aims to process and protect personal data at contemporary standards. In this context, the purpose of the Law is to regulate the conditions for processing personal data, the protection of fundamental rights and freedoms of individuals in the processing of personal data, procedures, and principles to be followed by real and legal persons who process personal data with the obligations of them.
Our company is obliged to comply with the Personal Data Protection Law No. 6698 and all personal data processed during its activity processes are within the scope of this law.
As ChemRAS Training and Chemical Consultancy Services Limited Company, we act as the data responsible and take the necessary measures to protect personal data.
General Principles in Processing Personal Data
Our company complies with the general principles set forth by Law No. 6698 in the processing of personal data. Our general principles in processing of personal data are as follows;
1) Lawfulness and fairness
2) Being accurate and kept up to date when necessary,
3) Being processed for specified, explicit and legitimate purposes,
4) Being relevant, limited and proportionate to the purposes for which they are processed,
5) Being stored for the period laid down by relevant legislation or the period required for the purpose for which the personal data are processed.
Although your personal data may vary depending on the service, product or commercial activity provided by our Company, it may be collected verbally, in writing or electronically by automatic or non-automatic methods through our Company's and member businesses' offices, branches, dealers, website, social media channels, mobile applications and etc.
In addition to that, your personal data may be processed when you call our company, visit our website, attend training, seminars, organizations and meetings organized by our company due to the intention of using our Company's services.
Legal Basis of Collection of Personal Data
Your personal data is obtained in all kinds of verbal, written or electronic media, in line with the purposes stated below, in order to be able to offer the products and services provided by our Company within the determined legal framework, and in this context, to fulfill our company’s responsibilities arised from the contract and the Law fully and accurately. Your personal data collected due to this legal basis can be processed and transferred for the purposes specified in this text within the scope of the conditions and purposes of personal data processing specified in Articles 5 and 6 of the Personal Data Protection Law.
Personal data is used by our Company for the following purposes;
Improving the services offered, developing new services and providing information about them,
Sending commercial e-mails, news, information, marketing of services,
Resolving customer problems and complaints,
Conducting statistical evaluations and market research,
Determining and implementing the company's commercial and business strategies,
Managing relationships with member businesses and business partners,
Follow-up of accounting and payment transactions,
Legal processes and compliance with legislation,
Answering information requests from administrative and judicial authorities,
Planning internal reporting and business development activities,
Performing financial controls and reporting and making legal notifications,
Managing internal control and audit activities,
- Ensuring information and transaction security and preventing misuse,
Making the necessary arrangements to ensure that the processed data is up-to-date and accurate and carrying out activities related to all these processes.
Transfer of Processed Personal Data
Our company may share your personal data with our domestic and international business partners, member businesses, banks, financial institutions, independent auditing institutions, etc., persons and institutions permitted by the Law on Payment and Securities Settlement Systems, Payment Services and Electronic Money Institutions and other legislative provisions. Stored data can be transferred within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Personal Data Protection Law.
Records and documents regarding the transactions carried out by our company with its customers are required to be kept for a certain period of time within the scope of legal regulations, and if you request to delete your personal data, your request can be fulfilled until the end of the period determined by the legal regulations. During this period, your personal data will not be processed and shared with third parties except for the obligations arising from the legal regulations.
Rights of the Personal Data Owner Specified in Article 11 of the Personal Data Protection Law
As personal data owners, if you submit your requests regarding your rights to our Company using the methods set out below in this Information Text, our Company will finalize the request without any fee within thirty days at the latest, depending on the property of the request. However, if a fee is foreseen by the Personal Data Protection Board, the fee in the price list determined by our Company will be charged. In this scope, personal data owners have the following rights;
to learn whether his/her personal data are processed or not,
to demand for information as to if his/her personal data have been processed,
to learn the purpose of the processing of his/her personal data and whether these personal data are used in compliance with the purpose,
to know the third parties to whom his/her personal data are transferred in the country or abroad,
to request the rectification of the incomplete or inaccurate data, if any, and to request reporting of the operations carried out in this context to third parties to whom his/her personal data have been transferred,
Even though it has been processed in accordance with the provisions of the Personal Data Protection Law and other relevant laws, to request the erasure or destruction of his/her personal data in case the reasons requiring processing are eliminated, and requesting to report of the operations carried out in this context to third parties to whom his/her personal data have been transferred,
to object to the occurrence of a result against the person himself/herself by analyzing the data processed solely through automated systems,
to claim compensation for the damage arising from the unlawful processing of his/her personal data.
In accordance with the 1st paragraph of Article 13 of the Personal Data Protection Law, you can submit your request regarding your above-mentioned rights to our Company in writing or by other methods determined by the Personal Data Protection Board. Since the Personal Data Protection Board has not determined any method at this stage, you must submit your application to our Company in writing, in accordance with the Personal Data Protection Law. In this context, the channels and procedures through which you can submit your application in writing to our Company within the scope of Article 11 of the Personal Data Protection Law are explained below.
